U.S. Court Rules DACA Suspension Memo is Invalid

Over the past weekend, a U.S. District Court in New York ruled that Acting Homeland Security Secretary Chad Wolf was appointed illegally, thus his memo suspending the DACA program is now invalid. Under the court order, DHS must accept initial DACA applications as well as renewals, grant advance parole travel documents, and issue two-year renewals (instead of one-year) to DACA beneficiaries. DHS is expected to appeal the district court decision. If you currently have DACA work authorization, you may continue to work pursuant to your valid employment authorization documents and should apply to renew your work authorization, as soon as possible.
