President Trump Issues Several Day 1 Immigration-related Executive Orders
Within the first twelve hours in office, President Trump issued dozens of Executive Orders, with several focusing on his immigration policy initiatives. He rescinded the executive orders and policies of the previous Biden administration, including a tech-focused order which expanded options to immigrants in high-tech fields such as AI or other STEM related fields. Key points of the orders include:
Additional funding and logistics for immigrant detention centers
Prohibiting “catch and release” policy of letting undocumented migrants into the U.S. while awaiting hearings or asylum cases, thus detaining all immigrants being put into the removal process
Withholding federal funding from “sanctuary jurisdictions”
Extreme vetting of foreign nationals
Enhanced security screenings for foreign nationals applying for visas and entry to the U.S. will likely create longer wait times at U.S. Embassies and Consulates
Potential for a future travel ban in 60 days after a report from the State Department, DHS, DOJ, and DNI identifying recommendations for countries that should have restriction on entry to the U.S.
Reimplenting the Migrant Protocol Protections, also known as “Remain in Mexico” policy at the southern border
Termination of humanitarian parole programs
Includes the Cuba, Haiti, Nicaragua, and Venezuela Parole program
Enhancing expedited removal of recent entrants to the U.S. who are deemed inadmissible by a CBP officer at a port of entry
Creating federal-state agreements to give local law enforcement the authorization to “perform the functions of immigration officers in relation to the investigation, apprehension, or detention of aliens in the U.S.”
Additional hiring of CBP and ICE officers
Denial of public benefits to undocumented individuals
Many of the policies within these orders are likely to be subject to federal lawsuits and may be placed on hold during litigation. Updates on any significant litigation will be provided here.
