Federal Court Fully Restores DACA

Late Friday night, December 4, a Federal Court in Brooklyn ordered Department of Homeland Security (DHS) to fully restore the Deferred Action for Childhood Arrivals (DACA) program. The court directs that new DACA applications, renewals, and grant advance parole travel documents, as well as issue two-year DACA and work authorization cards to beneficiaries. The Court order requires DHS to publish notice to members of a certified class of foreign nationals who may benefit from the re-implementation of the program. Public notice of the reinstatement and guidance on the application process must be published on the USCIS website within three days, expected Monday December 7. The DACA program provides work and travel authorization for undocumented young adults who were brought to the US as children.
