DOS expands validity of NIEs for travel from COVID-19 travel ban countries

On July 6, 2021, the U.S. Department of State revised their policy regarding the validity period of National Interest Exceptions (NIEs) granted by U.S. Embassies and Consulates for individuals traveling to the U.S. from countries currently under Presidential Proclamation travel restrictions due to the COVID-19 pandemic. Previously, NIEs were valid for 30 days and for a single entry. The new policy expands the validity to 12 months and multiple entries. Eligibility requirements have not changed. In order to qualify, an individual must demonstrate that they are “traveling to provide vital support or executive direction to critical infrastructure; those traveling to provide vital support or executive direction for significant economic activity in the United States; journalists; travel due to extraordinary humanitarian circumstances; or travel in support of national security or public health.” Those eligible for the 12 month NIE must continue to demonstrate their eligibility under this criteria. Details have not yet been released on documentation required to show continued eligibility.

Current COVID-19 travel bans to the US still remain in place for: UK, Ireland, Schengen Area in Europe, Brazil, Iran, South Africa, China, and India. Any updates on these travel restrictions will be posted by Lauren Jo Law.
